SB 323 Summary

• Adopts the Occupational Therapy Licensure Compact, allowing occupational therapists and occupational therapy assistants licensed in one member state to practice in other member states under a "compact privilege."

• Establishes the Occupational Therapy Compact Commission composed of delegates from member states to oversee licensure reciprocity, maintain a data system of licensure and disciplinary information, and promulgate uniform rules.

• Requires licensees to hold a valid unencumbered home state license, pass criminal background checks, complete any required jurisprudence exams in remote states, and meet continuing education requirements to obtain and maintain compact privileges.

• Preserves each state's regulatory authority to protect public health by allowing remote states to take adverse actions against practitioners and requiring home states to maintain exclusive disciplinary authority over their licensed practitioners.

• Requires the Department of Commerce and Consumer Affairs to adopt rules implementing the compact; effective December 31, 2050.
