General contractors with direct contracts to owners become liable for unpaid wages owed by subcontractors to their employees on private construction work not covered by chapter 104.

Liability is limited to unpaid wages and accrued interest only; does not extend to penalties, liquidated damages, or fringe benefits and contributions.

The director of labor or joint labor-management committees may enforce general contractor liability through legal action, with written notice required within 90 days of labor performance or 45 days after project completion.

Subcontractors must provide payroll records and project award information upon request, with general contractors able to withhold payments if records are not provided timely.

Actions to enforce unpaid wages must be filed within one year from date of labor performance or 45 days after project completion, whichever is earlier; effective July 1, 2112.
