S.B. 736 Summary

• Allows Hawaii Community Development Authority to approve residential development on parcels in Kakaako owned by Office of Hawaiian Affairs, with building height limit of 350 feet and maximum floor area ratio of 6.0

• Exempts residential developments on Office of Hawaiian Affairs parcels from requirements to dedicate public facilities or make cash payments in lieu, and from prohibitions on selling fee simple interest and residential development in Kakaako Makai area

• Requires residential development plans to include assessment and mitigation plan for noise, odor, and aircraft-related nuisances, with written notice to lessees and residents

• Appropriates $65,000,000 for fiscal years 2023-2024 and 2024-2025 to Office of Hawaiian Affairs for repairs to bulkheads and revetments on the conveyed parcels

• Appropriates additional funds to compensate Office of Hawaiian Affairs for difference between $200,000,000 owed for pro rata share of public land trust income (November 7, 1978 through June 30, 2012) and actual value of land received under Act 15 (2012)

• Effective July 1, 2050
