SB 74 Summary

• Expands exclusions from the "development" definition in Hawaii's special management area regulations to reduce permit requirements for certain activities.

• Removes the 7,500 square foot threshold for single-family residences and allows each county to define "single-family residence" by zoning ordinance for purposes of development permits.

• Adds new exclusions for public pedestrian and bicycle facilities, trash and invasive vegetation removal, fencing for habitat preservation, lighting and security improvements at existing public facilities, and Hawaiian traditional and customary practices.

• Maintains authority to reclassify excluded activities as "development" if they may have cumulative or significant environmental or ecological effects on special management areas.

• Takes effect July 1, 2050.
