Department of Labor and Industrial Relations must analyze Hawaii workers' compensation death benefit cases from the past ten years and obtain additional data from the Hawaii Insurers Council or other state and federal sources.

Department must examine whether updates are needed to Hawaii's Workers' Compensation Law, particularly section 386-41 HRS, which establishes weekly benefit amounts for surviving spouses, children, parents, and grandparents.

Analysis should address concern that the Department currently uses an actuarial table created in 1963 for calculating benefits, which may no longer reflect current longevity and generational dependency trends.

Department must submit findings and recommendations to the Legislature no later than twenty days before the start of the 2024 Regular Session.
