Repeals section 328-106, Hawaii Revised Statutes, which requires pharmacy benefit managers to maintain maximum allowable cost information and provide an appeal process for contracting pharmacies.

Finds that regulating pharmacy benefit manager business practices and reimbursement processes is outside the Hawaii Department of Health's expertise and mission to protect public health.

Determines that section 328-106 lacks adequate enforcement mechanisms and does not achieve meaningful balance in contractual relationships between pharmacy benefit managers and pharmacies.

Transfers future regulation of pharmacy benefit manager practices and drug reimbursement processes to other regulatory authorities better suited to oversee the insurance industry.

Takes effect upon approval.
