Commercial airport tenants, users, and contractors who violate federal, state, or county environmental protection laws or Department of Homeland Security regulations must reimburse the Department of Transportation for the entire amount of any resulting fines.

The Department of Transportation may demand, collect, and deposit reimbursements into the airport revenue fund and may also collect reimbursement for costs incurred enforcing this requirement.

The Department of Transportation may enter into capital advancement contracts with private parties for airport improvements or construction if determined to be less costly, more timely, or necessary due to lack of public financing availability.

Capital advancement contracts valued at $5,000,000 or less require no legislative approval; contracts exceeding $5,000,000 require approval by concurrent resolution prior to execution.

Total aggregate value of all capital advancement contracts in any calendar year cannot exceed $50,000,000; contracts must comply with procurement requirements and be subject to state audit.
