HB 1217 Summary

• Prohibits unauthorized persons from cultivating, producing, manufacturing, distributing, or dispensing cannabis for medical use; only qualifying patients, primary caregivers, and licensed dispensaries under chapter 329D are authorized.

• Limits "distribution" in medical cannabis context to transfers between a registered primary caregiver and the qualifying patient, and prohibits caregivers from using or accepting cannabis as compensation.

• Increases the maximum number of qualifying patients per grow site from five to fifty, unless exempted by the Department of Health, and authorizes inspections for compliance verification.

• Requires all qualifying patients to obtain medical cannabis from licensed dispensaries or their own cultivation after December 31, 2024, eliminating prior exemptions for certain patients and islands without dispensaries.

• Prohibits use of butane or other flammable solvents for cannabis processing; prohibits mischaracterizing cannabis transactions as other types of compensation; and clarifies unauthorized persons cannot receive protections for cannabis-related searches and seizures.
