HB 1441 Summary

• Establishes explicit right for patients to choose abortion or pregnancy termination necessary to protect life or health under Hawaii State Constitution provisions on equality, liberty, and privacy.

• Repeals criminal penalties (fines up to $1,000 and imprisonment up to 5 years) that previously applied to violations of abortion-related statutes in sections 453-16 and 457-8.7.

• Removes location restrictions that previously required aspiration abortions by advanced practice registered nurses to be performed only in hospitals or clinics, allowing performance in nurse's office.

• Clarifies that advanced practice registered nurses with prescriptive authority may provide medication and aspiration abortion care in first trimester of pregnancy, consistent with 2021 Act 3.

• Expands definition of "minor" from ages 14-17 to all persons under age 18 and updates "medical care and services" definitions to include prevention and treatment of sexually transmitted infections.
