Requires the Department of Health to establish and administer an electronic smoking device disposal program for collection and disposal of electronic smoking devices containing rechargeable lithium-ion batteries.

Mandates all retail tobacco stores that sell electronic smoking devices must participate in the disposal program.

Subjects retail tobacco stores that fail to collect and dispose of electronic smoking devices in compliance with the program to a fine (specific amount to be determined).

Directs the Department of Health to adopt rules under Chapter 91 to implement the disposal program requirements.

Takes effect upon approval; does not affect rights, duties, or proceedings that existed before the effective date.
