H.B. 1916 Summary

• Prohibits government agencies, persons, and organizations from publicly making available on the Internet protected personal information of covered public servants and their families upon written request

• Covered public servants include the governor, lieutenant governor, state department heads, legislators, Hawaii and federal judges, court administrators, election officials, and persons designated by the governor or chief justice for good cause

• Protected personal information includes home addresses, property ownership, contact numbers, email addresses, school locations of children, children's identities (under 18), and vehicle license plate numbers

• Recipients of valid written requests must remove protected personal information from publicly available websites, social media, and networks within three business days; extension to ten additional business days allowed with written acknowledgement

• Violations by private persons or organizations allow covered public servants to seek injunctive or declaratory relief in circuit court with recovery of costs and attorney's fees; violations by government agencies allow such relief but without fee awards
