H.B. 2007 Summary

• Allows religious institutions, educational institutions, and medical institutions to build dwelling units on land within the state urban land use district that they owned before January 1, 2024, subject to county development standards.

• Requires counties to allow a minimum density of at least ten dwelling units per acre for such projects, with limitations that development areas must be less than 15 acres and no greater than 50 percent of the parcel.

• Restricts dwelling units to homeless services or long-term rentals as defined by each county, and requires institutions to retain ownership of the units for as long as the institution remains in existence.

• Excludes industrial areas, hazardous areas, special management areas under chapter 205A, and areas zoned for one or fewer primary dwelling units per acre from this authorization.

• Sunsets on January 1, 2034, at which point section 46-4 of the Hawaii Revised Statutes returns to its previous form; effective date is July 1, 3000.
