State agencies must offer reinstatement with back pay to former employees who resigned or were dismissed solely for not complying with COVID-19 vaccination or testing requirements that were in effect during their employment.

Reinstatement offers must be made within 90 days after the Act takes effect.

If the former employee's original position is unavailable, the state agency must offer an equivalent position with equivalent pay, benefits, and terms and conditions of employment, plus back pay based on the original position.

State agencies covered include all executive, legislative, and judicial branch agencies, plus the Office of Hawaiian Affairs, Department of Education, and University of Hawaii.

The Act takes effect upon approval.
