H.B. 2123 Summary

• Requires owners or operators of waste combustion facilities to develop plans for continuous monitoring and sampling of 23 specified air contaminants including carbon dioxide, sulfur dioxide, dioxins, furans, mercury, lead, and other toxic substances.

• Requires owners or operators of municipal solid waste landfills to develop plans for continuous monitoring and sampling of contaminants as established by the Department of Health.

• Mandates creation of a publicly accessible website hosted by the Department of Health to display emissions data in real-time, with alerts for violations, downloadable archives, and violation highlights in red text.

• Requires facility owners to submit monitoring plans by October 1, 2024, and implement approved plans within three months; data from new monitoring equipment shall not be used for enforcement purposes until the director determines reliability.

• Appropriates general fund revenues to the Department of Health for planning and implementation of continuous monitoring requirements; effective July 1, 3000.
