HI HB2204

Amends Chapter 127A, Hawaii Revised Statutes to restrict use of emergency proclamations related to housing or affordable housing shortages from facilitating projects that include new luxury housing units or conversion of existing residential units to luxury units.

Defines "luxury housing unit" as a housing unit (for sale or rent) that is not affordable to a household earning a specified percentage of the applicable area median income as determined by the U.S. Department of Housing and Urban Development.

Establishes that this section takes precedence over any conflicting provisions in other laws or emergency proclamations.

Applies to housing or infrastructure projects developed under governor emergency proclamations issued on July 17, 2023; September 15, 2023; October 24, 2023; or any subsequent housing-related emergency proclamation.

Takes effect upon approval.
