H.B. 2210 - Emergency Management

• Clarifies that emergency powers granted to the governor and county mayors cannot be used to address economic pressures like housing crises or homelessness, except when directly caused by natural disasters, pandemics, or acts of war or terrorism.

• Requires any suspension of law during an emergency to identify the specific sections suspended, justify the suspension, and specify which emergency management functions are facilitated; suspensions must be no broader and last no longer than necessary.

• Establishes that state of emergency and local state of emergency automatically terminate 60 days after proclamation unless extended or terminated by separate proclamation, and allows the legislature to terminate an emergency by two-thirds affirmative vote.

• Authorizes the governor to require counties to obtain approval before issuing any emergency order, rule, or proclamation, and clarifies that the governor may re-declare a terminated state of emergency.

• Limits price control and tenant protection prohibitions to 72 hours after emergency declaration or 24 hours after severe weather warning is canceled, unless explicitly continued and identified by commodity type in a proclamation.
