HB 2453 Summary

• Authorizes the Governor or designated state official to transfer federal capitalization grant funds between the Water Pollution Control Revolving Fund and the Drinking Water Treatment Revolving Loan Fund, up to 33% of a fiscal year's drinking water treatment grant amount.

• Requires Attorney General certification that state law permits transfers and mandates capitalization grant agreements be amended to detail transfer methods before transfers occur.

• Prohibits using transferred funds to acquire state match for either fund or to secure/repay state match bonds; allows funds to be transferred on a net basis between the two programs.

• Directs the Department of Health to submit a report to the Legislature on all transfers between the two funds no later than 20 days before the 2025 Regular Session convenes.

• Effective July 1, 2024.
