Expands expungement eligibility for persons convicted of consuming a measurable amount of alcohol while under age 21 whose convictions predated current expungement provisions, including convictions under section 291-4.3 as it existed before Act 189, Session Laws of Hawaii 2000.

Excludes from underage alcohol expungement those persons holding a commercial learner's permit or commercial driver's license, or those convicted while driving a commercial motor vehicle or transporting hazardous materials.

Allows persons sentenced before June 22, 2006, for first-time class C felony property offenses under chapter 708 to apply for expungement if they would have qualified under current sentencing provisions and meet all expungement requirements.

Requires courts to find that applicants for retroactive expungement have complied with sentence terms, would have qualified for expungement at time of sentencing, have no subsequent felony convictions, and are currently nonviolent, or alternatively have successfully completed a substance abuse treatment program.

Provides that persons granted retroactive expungement under this Act are not eligible for another expungement under this section and takes effect upon approval.
