HB 2701 Summary

• Prohibits retaliation by associations, boards, managing agents, resident managers, unit owners, or their representatives against unit owners, board members, managing agents, resident managers, or association employees who take lawful action to address violations of condominium law, governing documents, or applicable laws and ordinances.

• Allows unit owners, board members, managing agents, resident managers, or association employees to bring civil actions in district court or circuit court for alleged retaliation violations, with courts authorized to issue injunctions, award damages, attorney's fees, court costs, or other appropriate relief.

• Grants claimants who bring retaliation civil actions in circuit court the right to a jury trial.

• Prohibits associations from using association funds or reserves to retaliate against unit owners or in any manner that would violate retaliation prohibitions in lawsuits against unit owners.

• Defines "retaliation" as actions taken in bad faith, unsupported by governing documents or applicable law, that are intended to or have the effect of being prejudicial to a person's substantial rights under condominium law or association governing documents.
