H.B. 2788 Summary

• Amends the definition of "dangerous to self" to include persons who are "gravely disabled" rather than requiring only recent threats or attempts of suicide or serious bodily harm.

• Adds new definitions for "gravely disabled" (unable to prevent physical or psychiatric deterioration or satisfy basic needs without supervision) and "psychiatric deterioration" (substantial impairment of judgment, reasoning, or ability to control behavior).

• Broadens "imminently dangerous to self or others" from forty-five days to ninety days, allowing intervention before a person reaches the point of imminent danger.

• Increases the maximum period of emergency hospitalization from forty-eight hours to seventy-two hours before a patient must be released unless voluntary agreement or court-ordered evaluation proceedings are initiated.

• Becomes effective July 1, 2024.
