H.B. 2795 Summary

• Requires toxic ash from the August 2023 Maui wildfires to be transported in sealed containers and disposed of at a licensed hazardous waste landfill or lined municipal solid waste landfill unit, with independent testing required for batches of 5 short tons or less to verify non-hazardous status.

• Requires incinerator ash from municipal solid waste combustion facilities to be disposed of at either a licensed hazardous waste landfill unit or a lined municipal solid waste landfill unit.

• Prohibits any person or public body from reusing toxic ash for any purpose, including daily landfill cover material, roadbuilding, fill, and other construction material.

• Prohibits any person or public body from reusing incinerator ash for any purpose, including roadbuilding, fill, and other construction material.

• Takes effect upon approval.
