HB 470 Summary

• Amends Section 346-17.6, Hawaii Revised Statutes, to clarify the definition of "provider" for entities offering no-cost emergency shelter and related services to minors.

• Expands "provider" definition to include organizations that are not licensed child placing organizations or child caring institutions, provided they meet five conditions: conduct annual criminal history and background checks on employees and volunteers, maintain separate sleeping areas for adults and minors, serve no more than five minor children per day, maintain a current register of admitted minors, and coordinate with the state department.

• Modifies the definition of "no cost emergency shelter and related services" to clarify it provides up to 30 days of accommodation including beds, meals, facilities, and ten types of services such as family reunification assistance, counseling, medical/dental care, and education services.

• Updates liability protections for providers offering no-cost services, maintaining immunity from civil or criminal liability unless gross negligence or willful/wanton acts occur.

• Sunsets on June 30, 2029, with prior law automatically reenacted unless further legislative action occurs.
