State agencies must offer reinstatement with back pay within 90 days of the Act's effective date to former employees who resigned or were dismissed solely for not complying with COVID-19 vaccination or testing requirements.

If the former employee's original position is unavailable, the state agency must offer an equivalent position with equivalent pay, benefits, and employment terms, along with back pay based on the original position.

"State agency" includes all executive, legislative, and judicial branch agencies, the office of Hawaiian affairs, the department of education, and the university of Hawaii.

The Act applies only to employees terminated while a proclamation, order, or policy requiring COVID-19 vaccination or regular SARS-CoV-2 testing was in effect.

The Act takes effect upon approval.
