H.B. 683 Summary

• Requires defendants convicted of driving under the influence (DUII) of an intoxicant who killed a parent of a minor child to pay child support/maintenance to the deceased parent's children as restitution.

• Child maintenance payments must continue until each child reaches 18 years of age and has graduated from high school, or until the child's graduation class completes high school.

• Court must determine reasonable maintenance amount based on child's financial needs, surviving parent/guardian resources, standard of living, child's physical/emotional condition, custody arrangements, and work-related childcare expenses.

• Payments are ordered to the court clerk as trustee for remittance to the surviving parent or guardian within three working days of receipt.

• Defendants incarcerated at sentencing have up to one year after release to begin payments; any unpaid arrearage continues as an obligation until fully satisfied.
