HB 745 Summary

• Expands Hawaii's equal pay law to prohibit compensation discrimination based on race, gender identity or expression, sexual orientation, age, religion, color, ancestry, disability, marital status, arrest and court record, or domestic or sexual violence victim status, not just sex.

• Requires employers to provide pay scale information to job applicants upon request, disclose wage ranges in all job listings, and provide employees with wage ranges for their position and substantially similar positions annually and upon request.

• Clarifies that compensation differentials are permitted only if they result from non-discriminatory seniority systems, merit systems, objective production measures, or other non-discriminatory factors that neither purpose nor effect discrimination.

• Creates an exception to wage discussion protections allowing employers to discuss employee wages if knowledge stems from human resources, payroll, or legal professional responsibilities in the workplace.

• Effective July 1, 2023.
