S.B. 1104 Summary

• Amends the definition of "cannabis" to include cannabis propagules, cuttings, and seeds, enabling licensed medical cannabis dispensaries to sell these propagative materials to qualifying patients and caregivers.

• Allows qualifying patients, primary caregivers authorized to cultivate cannabis, qualifying out-of-state patients, and their caregivers to purchase up to 5 cannabis propagules, cuttings, or seeds within 15 consecutive days, or up to 10 within 30 consecutive days.

• Requires all cannabis propagules, cuttings, and seeds dispensed to undergo laboratory-based testing for residual pesticides and heavy metals with no detectable contamination.

• Mandates that dispensary tracking systems submit inventory data on cannabis propagules, cuttings, and seeds to the Department of Health and track customer purchases of these propagative materials subject to the established quantity limits.

• Requires the Department of Health to adopt rules governing the dispensing of cannabis propagules, cuttings, and seeds; effective June 30, 3000.
