SB 1465 Summary

• Allows selection committees to rank fewer than three qualified persons for professional services when fewer than three qualified responses are received to a solicitation, with chief procurement officer approval.

• Permits direct negotiations with a single qualified person when no qualified responses are received, if the chief procurement officer determines resolicitation is not feasible due to time constraints or marketplace conditions.

• Requires posting of "Notice of No Interest Received and Intent to Directly Negotiate" on a public website for seven days with a seven-day objection period before proceeding with direct negotiations.

• Makes determinations under these procedures final and conclusive unless clearly erroneous, arbitrary, capricious, or contrary to law.

• Makes technical corrections to Hawaii Revised Statutes § 103D-304 and takes effect July 1, 2112.
