S.B. 2139 Summary

• Establishes that reproduction of government records during a nationally declared disaster shall not exceed 25 cents per page, with the first 100 pages provided free if disclosure serves the public interest.

• Exempts electronic documents from reproduction costs if maintained in electronic format by the agency; agencies may charge for converting documents to electronic format.

• Requires the Office of Information Practices to adopt rules setting fees not exceeding $5 per 15 minutes for searching records and $7.50 per 15 minutes for review and segregation during nationally declared disasters.

• Mandates fee waivers for records disclosure during disasters when it serves the public interest, would contribute significantly to public understanding of government operations, and is not primarily commercial in nature.

• Takes effect July 1, 2112.
