Lowers the blood alcohol concentration (BAC) threshold for driving under the influence from 0.08 to 0.05 grams per 100 milliliters of blood or per 210 liters of breath.

Modifies the definition of "measurable amount of alcohol" from 0.08 to 0.05 BAC and updates the definition of "under the influence" to reference the new 0.05 threshold.

Updates presumptions in DUI prosecutions so that 0.02 or less BAC is presumed not impaired, and BAC between 0.02 and 0.05 may be considered with other evidence but creates no presumption.

Applies the 0.05 BAC standard to administrative license revocation proceedings and criminal prosecutions under sections 291E-61 (operating vehicle under influence) and 291E-61.5 (habitual DUI offender).

Takes effect upon approval and does not affect rights, duties, or proceedings that began before the effective date.
