SB 2425 Summary

• Appropriates $150,000 from the water pollution control revolving fund to the Department of Health for fiscal year 2024-2025 to hire consultants to develop a comprehensive public outreach strategy and website about cesspool conversion requirements and resources.

• Authorizes the Department of Health to identify necessary public outreach and education resources and tools in consultation with counties, nonprofit organizations, and wastewater industry professionals.

• Requires sellers of residential real property containing a cesspool to disclose to buyers whether the property has a cesspool, the priority level according to the Hawaii cesspool hazard assessment and prioritization tool, and the legal deadline for upgrading or converting it.

• Amends section 508D-15, Hawaii Revised Statutes, to add cesspool disclosure requirements to existing mandatory seller disclosure obligations for residential real estate transactions.

• Takes effect July 1, 2024, except the cesspool disclosure requirement takes effect November 1, 2024.
