S.B. 2545 Summary

• Authorizes manufacturers of electronic devices to negotiate, collaborate, and coordinate with each other and other entities to develop and implement recycling plans, with immunity from federal antitrust laws and Hawaii state antitrust law (chapter 480).

• Adds new provision allowing manufacturers to satisfy recycling goals by providing only collection service locations at no cost to owners in each county and zip code tabulation area with population greater than 25,000, rather than meeting weight-based collection targets.

• Permits manufacturers to collaborate through a coordinating body to collectively provide collection locations and use proportional obligations to reconcile each manufacturer's individual recycling requirements.

• Requires manufacturers choosing to comply with the collection location option to disclose this intent in their annual plans submitted to the department.

• Exempts collaborative manufacturer activities from antitrust scrutiny by confirming state supervisory activities constitute active state supervision.
