S.B. 2569 Summary

• Creates new section 321 allowing employers or contractors of health care workers to report acts of violence to law enforcement with the health care worker's consent, while preserving the worker's right to self-report.

• Amends section 604-10.5 to permit employers or contractors of health care workers to petition district courts for temporary restraining orders and injunctions against harassment at health care facilities on behalf of harassed workers with their consent.

• Defines "act of violence" as intentional or knowing use of force causing bodily injury or threats of bodily injury; defines "health care worker" as employees or independent contractors providing health care services in health care facilities.

• Grants immunity from civil liability to employers/contractors who initiate harassment proceedings or investigate alleged incidents in good faith, and protects health care workers and witnesses participating in investigations from liability except for actions taken with malicious intent or false statements.

• Establishes that the measure does not create or limit duties regarding workplace safety, restrict other legal remedies, affect workers' compensation exclusivity, or limit employee organizing rights under Hawaii law.
