SB 2601 Summary

• Expands statute of limitations for civil actions based on childhood sexual abuse committed on or after July 1, 2024, from 8 years to 32 years after the victim's eighteenth birthday, or 5 years after discovery of psychological injury (whichever is later).

• Maintains existing statute of limitations (8 years or 3 years after discovery) for sexual abuse committed before July 1, 2024.

• Allows plaintiffs to request and courts to order personnel of legal entities (defendants) to undergo training on trauma-informed response to allegations of sexual abuse.

• Requires certificate of merit filed by plaintiff's attorney, including notarized statement from licensed mental health professional confirming reasonable basis to believe plaintiff was subject to sexual abuse.

• Does not apply retroactively and does not revive actions that have already passed the previous statute of limitations deadline.
