SB 2758 Summary

• Authorizes civil claims against businesses, business owners, or business operators who profit from sexual exploitation or sex trafficking of individuals.

• Expands the definition of "sex trafficking" to include both section 712-1202 and 712-1203 offenses, and introduces "sexual exploitation" as a key term replacing references to "prostitution."

• Adds a fourth cause of action allowing individuals to sue defendants who profited from coercion into sexual exploitation or sex trafficking, in addition to existing causes of action for direct coercion and earnings collection.

• Extends the statute of limitations from six years to ten years for filing civil claims, with tolling during the plaintiff's minority and during any active criminal investigation or prosecution.

• Allows recovery of economic damages, noneconomic damages, exemplary damages, reasonable attorney's fees, and costs of suit from defendants liable under the act.
