Amends Hawaii Revised Statutes Section 103D-709(e) regarding cash or protest bonds required for procurement disputes.

Changes bond return policy so bonds are returned to initiating parties minus administrative costs determined by the Office of Administrative Hearings, regardless of whether the party prevails.

Provides for full forfeiture of the bond only if the initiating party loses the administrative proceeding and the Office of Administrative Hearings finds the appeal was frivolous or made in bad faith.

Forfeited bonds are deposited into the state general fund.

Takes effect upon approval.
