S.B. 2883 Summary

• Requires the Department of Education to ensure accurate and inclusive curricula are available to all students in public schools beginning with the 2025-2026 school year, in accordance with age guidelines.

• Makes it a discriminatory practice to refuse approval, remove, or prohibit curricular materials from schools or public libraries based on content addressing race, color, ancestry, sex (including gender identity, gender expression, or sexual orientation), religion, disability, or materials written by LGBTQ+ individuals.

• Establishes a complaint process for individuals to report schools or school complexes not in compliance with inclusive curricula requirements to the Department of Education.

• Allows individuals claiming to be aggrieved by discriminatory practices to file complaints with the Hawaii Civil Rights Commission under Chapter 368 procedures.

• Defines "inclusive curricula" as materials that accurately portray cultural and racial diversity, recognize contributions of people of all genders in all roles, address diverse cultures and nationalities, and reflect the roles and contributions of Native Hawaiians, Native Americans, African Americans, Latino Americans, Asian Americans, Pacific Islanders, European Americans, and other diverse groups.
