SB 3103 Summary

• Requires persons constructing covered renewable energy projects (1 megawatt or greater capacity) to file a signed attestation or declaration with the Department of Business, Economic Development, and Tourism within 30 days of construction commencement.

• Attestation must confirm that all contractors and subcontractors will use apprentices from state-approved programs, maintain workplace harassment/discrimination prevention policies, remain properly licensed, demonstrate compliance with workers' compensation and safety rules, and comply with wage and hour laws.

• Requires contractors and subcontractors to provide quarterly reporting to the project owner or electric utility, offer health care and retirement benefits to employees, and comply with public works requirements under Chapter 104.

• Attestation is for reporting purposes only and the department shall not investigate, regulate, or enforce based on the filed attestation.

• Exempts projects from requirements if contractors unable or unwilling to comply and all reasonable attempts to procure compliant contractors have been made; effective July 1, 3000.
