SB 3147 Summary

• Clarifies that the Director of Law Enforcement has authority to issue subpoenas as part of the department's investigative powers.

• Authorizes the director to subpoena witnesses, examine them under oath, and require production of books, papers, documents, records (including electronically stored records) relevant or material to civil, administrative, or criminal investigations.

• Subpoenas must state the issuing authority, command attendance at a specified time and place, may be served by any law enforcement officer statewide, and must contain a statement of the recipient's rights and procedures for contesting the subpoena.

• Requires the department to reimburse financial institutions for costs of complying with subpoenas at rates of $15 per hour for research time and 50 cents per page for reproduction.

• Allows circuit courts to compel obedience to subpoenas upon application by the Attorney General and permits courts to quash or modify subpoenas if compliance would be unreasonable, oppressive, or violate witness privileges; effective July 1, 2024.
