S.B. 3185 Summary

• Adds new alternative procurement method to Hawaii Revised Statutes Chapter 103D allowing procuring agencies to use federal-approved procurement methods when the agency head determines in writing that standard methods are not practicable or advantageous.

• Requires documentation of federal statute, regulation, experimental project, demonstration project, or federal approval to be included in contract files for alternative procurements.

• Amends procurement exemptions in HRS 103D-102(b)(4) to explicitly include construction services that are not practicable or advantageous to procure competitively.

• Authorizes the Chief Procurement Officer to waive restrictions on outside contractors who participated in developing solicitation packages, if the officer determines it is in the State's best interest.

• Effective date: July 1, 2112.
