Prohibits construction, modification, or expansion of municipal solid waste landfills, construction and demolition landfills, or their components for solid waste or hazardous waste on land near or above significant aquifers as determined by the Department of Health in consultation with the Commission on Water Resource Management.

Requires the Department of Health to determine what constitutes land "near or above a significant aquifer" in consultation with the Commission on Water Resource Management.

Maintains existing requirement for one-half mile buffer zone around waste or disposal facilities from residential, school, and hospital property lines for new construction, modification, or expansion.

Exempts continued operation of existing, properly permitted waste or disposal facilities from the buffer zone requirement unless physical expansion (vertical or horizontal) requires additional permitting review and permit modification.
