S.C.R. NO. 91 Summary

• Authorizes the Board of Land and Natural Resources to cancel Governor's Executive Order No. 3006 and issue a new executive order for 19.289 acres (original 18.755 acres plus 0.534 acres) to the County of Maui, Department of Environmental Management for the Wailuku-Kahului Wastewater Reclamation Facility.

• Updates the original 1980 executive order to reflect a 0.534-acre shoreline revetment area that was constructed by the U.S. Army Corps of Engineers in 1979 but extended beyond the original set-aside boundaries, discovered during a 2014 shoreline certification process.

• Transfers the executive order from the County of Maui Department of Public Works to the County of Maui Department of Environmental Management, which now operates and maintains the sewage treatment plant.

• Authorizes the issuance of a perpetual non-exclusive easement (approximately 8,666 square feet) to the County of Maui, Department of Environmental Management for wastewater force main purposes on Tax Map Key (2) 3-8-001: Portion of 119, located along Amala Place.

• Implements recommendations from the Board of Land and Natural Resources approved January 8, 2021, and requires the Attorney General's approval pursuant to sections 171-11 and 171-95 of the Hawaii Revised Statutes.
