H.B. 1114 - Harm Reduction Summary

• Repeals the one-to-one sterile needle and syringe exchange limit and authorizes needs-based distribution that provides quantities sufficient to reduce sharing and reuse.

• Allows non-injection drug users to participate in and receive services (excluding syringes and needles) from the Sterile Needle and Syringe Exchange Program.

• Provides criminal liability immunity for program staff and syringe exchange participants for possession or delivery of needles, syringes, and authorized objects (such as cookers, cottons, and ties) during program activities.

• Extends immunity to syringe exchange participants for possession of used needles or syringes containing drug residue (amounts less than 0.05 milliliter) within one month after their last program visit.

• Protects law enforcement officers acting in good faith from civil liability for arrests or charges later determined to be exempt under this section.
