State agencies must offer reinstatement with back pay to former employees who resigned or were dismissed solely for not complying with COVID-19 vaccination or testing requirements that were in effect under any proclamation, order, or policy.

Reinstatement must be offered to the former employee's original position if available, or to an equivalent position with equivalent pay and benefits if the original position is unavailable.

Back pay must be provided based on the position the former employee held prior to termination.

"State agency" includes all executive, legislative, and judicial branch agencies, the Office of Hawaiian Affairs, the Department of Education, and the University of Hawaii.

State agencies have 90 days after the Act's effective date to make reinstatement offers to eligible former employees.
