Establishes payment rates for nonprescription drugs, over-the-counter drugs, and nonlegend drugs in workers' compensation cases, capped at cost plus 40 percent.

Requires that payment for such drugs only be authorized when the provider clinically establishes the drug is necessary to treat the injured employee's work injury.

Allows providers to seek separate reimbursement for applicable Hawaii general excise tax on these drugs.

Defines "nonprescription drug," "over-the-counter drug," and "nonlegend drug" by reference to Hawaii Revised Statutes section 328-1, and defines "provider" as the physician dispensing the drug.

Takes effect July 1, 3000 (note: appears to be a drafting error in the effective date).
