Change Hawaii Medical Board authority from "may" to "shall" establish standards for health care providers regarding informed consent for patients or their guardians/legal surrogates.

Require informed consent to be obtained before the date of treatment or procedure; if scheduling and treatment occur on the same day, consent must be obtained when the decision is made to schedule the procedure.

Allow confirmation of previously obtained informed consent to be gathered from the patient or their guardian/legal surrogate on the day of treatment or procedure.

Maintain existing requirements that informed consent information include the patient's condition, proposed treatment description, anticipated results, alternative treatments, recognized material risks, and benefits of alternatives.

Exempt emergency treatment or procedures from informed consent requirements when obtaining consent is not reasonably feasible without adversely affecting the patient's health.
