Department of Health shall establish a state breast milk bank to accept and provide breast milk to assist parents and guardians in providing breast milk to their infant children.

Department of Health shall adopt rules establishing eligibility criteria for entities to administer the breast milk bank under contract and standards for screening, processing, transporting, and distributing human breast milk.

State breast milk bank may collect reasonable fees from users to support operations.

Establishes a state breast milk bank special fund administered by the Department of Health, funded by user fees, federal funds, legislative appropriations, and accrued interest.

Appropriates funds from general revenues for fiscal year 2025-2026 to the special fund and from the special fund for operation of the breast milk bank in fiscal years 2025-2026 and 2026-2027; effective July 1, 2025.
