HB 256 Summary

• Requires waste-to-energy facility owners and operators to comply with specific US Environmental Protection Agency (EPA) emission standards from Title 40 Code of Federal Regulations Part 60 as they existed on December 31, 2024.

• Applies to five subparts of EPA regulations: General Provisions (Subpart A), Large Municipal Waste Combustors constructed before September 20, 1994 (Subpart Cb), Municipal Waste Combustors constructed between December 20, 1989 and September 20, 1994 (Subpart Ea), Large Municipal Waste Combustors constructed after September 20, 1994 or modified after June 19, 1996 (Subpart Eb), and Small Municipal Waste Combustion Units constructed after August 30, 1999 (Subpart AAAA).

• Allows emission limits to be made more stringent through either federal regulations or state air pollution control permits issued by the Department of Health.

• Takes effect on December 31, 2050, and is automatically repealed on June 30, 2027.
