HB 359 Summary

• Expands the definition of "sexual offense" requiring covered offender registration to include sexual assault in the fourth degree by indecent exposure, sexual assault in the fourth degree against minors aged 16+ committed by professionals, incest, sexual assault of animals, and use of a computer in committing covered offenses.

• Requires public disclosure of registration information for all covered offenses committed against minors, regardless of whether the conviction is a first-time misdemeanor offense.

• Changes the annual in-person reporting requirement from the offender's actual date of birth to the thirty-day period following the offender's birthday.

• Establishes tiered registration termination requirements: Tier 3 offenses require lifetime registration; Tier 2 offenses allow petition after 25 years of clean record; Tier 1 offenses allow petition after 10 years of clean record; all offenders may petition after 40 years.

• Specifies that computer-facilitated offenses under section 708-893 are tiered according to the underlying separate crime's tier classification.
