H.B. 615 - Health Care Access Protection Act

• Establishes protections for gender-affirming health care services comparable to existing reproductive health care protections, including prohibiting state agencies from assisting out-of-state investigations or disclosing patient information related to these services

• Prevents Hawaii courts from enforcing out-of-state laws that authorize child removal based solely on parents allowing children to receive gender-affirming health care services

• Amends child custody jurisdiction laws to recognize cases involving gender-affirming health care services as establishing sufficient connection to Hawaii and prohibits courts from declining jurisdiction when another state limits such services

• Protects healthcare providers and professionals by preventing license denial or discipline based on providing or assisting with gender-affirming health care services that are lawful in Hawaii or would be lawful if performed in Hawaii

• Prohibits issuance of subpoenas to summon witnesses for out-of-state prosecutions involving reproductive or gender-affirming health care services unless those acts would also be criminal offenses under Hawaii law
