H.B. 644 Summary

• Prohibits businesses that package and sell food or beverages on-premises from using, selling, or distributing disposable or single-use plastic food ware (cups, lids, containers) effective January 1, 2026.

• Allows exemptions for reusable/refillable containers, compostable plastics (certified to ASTM standards D6400 and D6868 with regional collection access), and packaging in declared emergencies.

• Bans food service items containing regulated perfluoroalkyl and polyfluoroalkyl substances (PFAS) at concentrations of 100 parts per million or higher, or intentionally added PFAS with functional effects in the product.

• Establishes enforcement through the department with penalties of $100-$1,000 per day of violation for continued distribution after an order to discontinue, and authorizes civil action for injunctive relief.

• Defines "plastic" to include polyethylene terephthalate, polystyrene, polylactic acid, and biopolyesters, while excluding natural rubber, aluminum, glass, paper, and bamboo.
